Samsung Galaxy Nexus granted a stay on sales ban

02 August 2012 – You can still get your hands on a Galaxy Nexus in the U.S, after Samsung dodged a ban on its popular smartphone.


The US Court of Appeals for the Federal Circuit ruled in Samsung's favour by extending the suspension of the preliminary injunction of the Nexus on Monday.


In June, U.S. District Judge Lucy Koh granted Apple its request for a temporary ban on the Nexus, which was then ruled to have infringed on several Apple patents. Samsung then appealed the ruling on July 1st, but the judge denied lifting the ban. Apple then posted a $96.5 million bond to cover Samsung's losses in case the case is ruled in Samsung’s favour.


The Korean firm then appealed directly to the U.S. Court of Appeals, who then granted a stay on the Nexus ban. The stay will extend Galaxy Nexus sale until August 20th when a hearing will take place to make a final decision on Samsung’s appeal.


While Apple and Samsung are currently going head on with each other in a San Jose courtroom, Foss Patents' Florian Mueller said this appeals case should not affect the other case’s ruling or action.


Mueller adds that the extension of the stay is "moderately favourable to Samsung".
